Acceptance of Terms

By accessing or using Magical Hekaya ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

Service Description

Magical Hekaya is an AI-powered platform that creates personalized children's storybooks. Parents and guardians upload their child's photo and provide basic details, and our platform generates illustrated stories where the child becomes the main character. The Service includes digital storybooks, audio narration, PDF downloads, and optional physical print-on-demand books.

User Accounts

Account creation and authentication are managed through Clerk, our authentication provider. By creating an account, you represent that:

  • You are at least 18 years of age or the age of majority in your jurisdiction.
  • You are a parent or legal guardian of any child whose information you provide.
  • All information you provide is accurate and complete.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.

Content & Intellectual Property

The stories and illustrations generated through our platform are created using artificial intelligence. Regarding ownership and usage rights:

  • Your Content: You retain ownership of any photos and personal information you upload to the platform.
  • Generated Content: Upon purchase, you receive a personal, non-exclusive, non-transferable license to use the AI-generated storybooks for personal, non-commercial purposes. This includes viewing, downloading, printing, and sharing with family and friends.
  • Platform IP: Magical Hekaya retains all rights to the platform, story templates, AI models, software, branding, and underlying technology. You may not reproduce, distribute, or create derivative works from any platform content beyond your purchased storybooks.

Digital Products Policy

Please review this section carefully before making a purchase:

  • All digital products (storybooks, audio narration, PDF downloads) are non-refundable once generated. Due to the personalized nature of our products and the computational resources required for AI generation, we cannot offer refunds on completed digital products.
  • If story generation fails due to a technical error on our end, we will provide a free retry at no additional cost.
  • For physical print-on-demand products, refunds or replacements may be offered in cases of shipping damage or printing defects. Please contact us within 14 days of delivery.
  • If you experience any issues with your order, please contact us and we will work to resolve the situation fairly.

Acceptable Use

When using Magical Hekaya, you agree not to:

  • Upload photos of children you do not have legal guardianship or parental authority over.
  • Use the Service for any unlawful, harmful, or fraudulent purpose.
  • Attempt to reverse-engineer, decompile, or extract the AI models or algorithms used by the platform.
  • Resell, redistribute, or commercially exploit generated content without written permission.
  • Upload inappropriate, offensive, or harmful content.
  • Abuse the Service by making excessive requests designed to overload our systems.

Limitation of Liability

Magical Hekaya is provided on an "as is" and "as available" basis. To the fullest extent permitted by law:

  • We do not guarantee uninterrupted, error-free, or perfectly accurate AI-generated content.
  • We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Our total liability for any claim related to the Service shall not exceed the amount you paid for the specific product giving rise to the claim.
  • We are not responsible for delays or failures in print-on-demand fulfillment caused by third-party providers.

Changes to Terms

We may modify these Terms of Service at any time. When we make material changes, we will notify registered users via email and update the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms. If you disagree with any changes, you should discontinue use of the Service and delete your account.
